When a construction dispute arises, the decisions made in the first few days matter. How quickly you move, what you put in writing, and which process you choose can all affect the outcome.
We provide specialist dispute advisory services to contractors, employers, and developers across Ireland and the UK. We can advise on your position, prepare or defend a claim, and guide you through the appropriate resolution process.

Adjudication
Adjudication under the Construction Contracts Act 2013 is the primary mechanism for resolving payment disputes in Ireland. It's fast — decisions are issued within 28 days — and binding, subject to review. We have experience acting for both referring and responding parties, from the notice of intention to refer through to enforcement.

Arbitration
Arbitration in Ireland is governed by the Arbitration Act 2010. In most standard-form construction contracts in Ireland, arbitration is the final dispute mechanism.

Mediation
Mediation is a voluntary, confidential process in which a neutral third party helps the parties reach a negotiated settlement. It can be used at any stage of a dispute and is often the most cost-effective route to resolution. We advise clients on whether mediation is appropriate and assist in preparing for and presenting at a mediation.

Expert Determination
In expert determination, the parties appoint an independent construction expert whose decision on the dispute is binding. Mark Etherington has been appointed to carry out expert determinations and is available to advise parties on the process, or to accept appointment as expert where appropriate.
